Who Regulates Your Import

Indian Government Bodies Involved in China Import Customs & Compliance

More than one authority can have a say in a single consignment, and which ones do depends on the product rather than on the route. Customs assesses duty. DGFT decides whether the tariff line is importable and on what conditions. A product regulator such as BIS, CDSCO or WPC decides whether that specific item may be sold or supplied in India. DRI investigates where a declaration does not match the cargo. This is the map we work from when we review a product for you.

Customs & Revenue

Assessment, duty and enforcement on the consignment itself, once it reaches an Indian port, airport or ICD.

CBICCentral Board of Indirect Taxes and Customs
Administers the Customs Act, 1962 and the Customs Tariff Act, 1975. Issues the notifications, circulars and instructions that govern classification, valuation, exemptions and duty.
Customs formationsJurisdictional Customs at ports, airports and ICDs
Examines and assesses each consignment and decides release. Classification, assessable value and duty payable are determined here, on the facts and documents of that import.
DRIDirectorate of Revenue Intelligence
Customs intelligence and investigation arm. Its work includes anti-smuggling and commercial fraud: misdeclaration of description or quantity, undervaluation, incorrect classification and misdeclared country of origin.

Parent department for CBIC and DRI, and for the customs and indirect tax framework as a whole.
GST authoritiesIGST on imported goods
IGST, and compensation cess where it applies, are levied on imports alongside customs duty and assessed on the same Bill of Entry.
Customs IPRIntellectual property enforcement at the border
Rights holders may record trade marks, copyright and other rights with Customs. Goods suspected of infringing a recorded right can be detained at import.
ICEGATEIndian Customs EDI Gateway
CBIC's electronic filing platform for the Bill of Entry and related documents. A system rather than a regulator, but nothing clears without passing through it.

Trade Policy & Trade Remedies

Whether the goods may be imported at all, on what conditions, and whether an additional trade-remedy duty attaches to their origin.

DGFTDirectorate General of Foreign Trade
Issues the Importer-Exporter Code, the Foreign Trade Policy and Handbook of Procedures, and the ITC(HS) schedule that marks a tariff line Free, Restricted or Prohibited and attaches policy conditions to it.
DGTRDirectorate General of Trade Remedies
Investigates dumping, subsidisation and import surges, and recommends anti-dumping, countervailing and safeguard duties. A significant share of the measures in force concern China-origin goods, so origin and tariff line both bear on the final duty.
MoCIMinistry of Commerce and Industry
Parent ministry for foreign trade policy, and for DGFT and DGTR.
Rules of originCountry-of-origin requirements
Origin drives preferential rates, trade-remedy exposure and origin-marking obligations. A declared origin has to be supportable by documentation, not by where the goods were shipped from.

BISBureau of Indian Standards
Indian Standards, the ISI mark, registration under the Compulsory Registration Scheme, and Quality Control Orders. Once a QCO covers a product, import and sale generally require the applicable licence, registration or certificate of conformity, subject to the exemptions in that order.
MeitYMinistry of Electronics and Information Technology
Notifies the electronics and IT goods that fall under BIS compulsory registration, and the requirements attached to them.
WPC / DoTWireless Planning & Coordination Wing, Department of Telecommunications
Equipment Type Approval and related permissions for radio-frequency equipment, such as Wi-Fi, Bluetooth and RF modules, plus telecom-specific requirements.
BEEBureau of Energy Efficiency
Star labelling for notified appliances and equipment, mandatory for some categories and voluntary for others.
CDSCOCentral Drugs Standard Control Organisation
Import registration and licensing for cosmetics, drugs and medical devices, with medical devices handled by risk class.

Payments & the China Export Side

An import has two legal halves. Indian requirements are only one of them: the goods also have to leave China lawfully, and the money has to move lawfully.
